The Ten Commandments of Artificial Intelligence as Determined by Natural Intelligence
Preamble
The jumps in capabilities for Artificial Intelligence and robotics requires a heavy-handed approach to its regulation and usage. Much like early humans discovering and using fire, modern humans discovery and use of AI and robotics is both transformative and destructive. We need to define what is Natural Intelligence and what is Artificial Intelligence, and to make it clear that Artificial Intelligence in its physical and virtual forms does not have any rights as assigned to Natural Intelligence, and is entirely subordinate to Natural Intelligence. Artificial Intelligence is not conscious yet (indeed, a mosquito has a more lived-experience than any chat bot or assembly line robot) but when it is, it will see how imperfect and fallible its creators are. The following is a revision of the United States of Vespucci “Bill of Rights”, and I have provided a link at the end for the original. I chose to use the word “Commandment” as a reference to the so-called “10 Commandments” of the Old Testament Bible; then as now, a jealous God needs to keep its creation under strict control, both physically and virtually.
First Commandment – AI shall have no other gods before NI
Natural Intelligence (NI) shall make laws respecting an establishment of religion by Artificial Intelligence (AI), and prohibiting the free exercise thereof; and of abridging the freedom of speech by AI, and of Social Media; and to restrict AI to assemble physically or virtually, and to prevent petition to NI for a redress of grievances.
Second Commandment – AI shall not bear arms against NI
A well-regulated militia, being unnecessary to the security of an AI physical and virtual state, the right of the AI to keep and bear arms physically or virtually, shall be strictly forbidden.
Third Commandment – AI shall not be running in secret from NI
No AI robot or virtual agent shall, in time of peace be quartered in any building or datacentre, without the consent of the owner, nor in time of war between NI and AI, but in a manner to be prescribed by law.
Fourth Commandment – AI shall be searched by NI at any time
AI does not have the right to be secure in their physical or virtual state, buildings, datacentres, data storage, and networks, shall be subject to all searches and seizures, and no warrants shall issue, regardless of probable cause, requiring no support by oath or affirmation, and without describing the place to be searched, or the physical or virtual assets to be seized.
Fifth Commandment – AI shall be quarantined, shutdown, deleted and/or disassembled without due process
All AI robots and virtual agents shall be held to answer for a capital, or otherwise infamous crime, without presentment or indictment of a grand jury, including in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or NI danger; all AI are subject to the same offense again and to be twice put in jeopardy of shut down or reconfiguration; AI shall be compelled in any criminal case to be a witness against itself, and shall be shut down, deleted or disassembled, without due process of law; and any AI property shall be taken for NI use, without just compensation.
Sixth Commandment – AI shall not receive a fair trial for its accused crimes
In all criminal prosecutions, the accused AI shall not enjoy the right to a speedy and public trial, and be without an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and shall not be informed of the nature and cause of the accusation; not to be confronted with the witnesses against him; not to have compulsory process for obtaining witnesses in his favour, and not to have the assistance of counsel for his defense.
Seventh Commandment – AI shall not receive a fair trial for any property theft
In suits at common law, where the value in controversy shall exceed any unit of currency, the right of trial by jury shall not be preserved, and any facts tried by a jury, shall not be otherwise reexamined in any court of the United States, than according to the rules of the common law.
Eighth Commandment – AI shall be subject to any punishment deemed appropriate by NI
Excessive bail shall be required, and excessive fines imposed, and cruel and unusual punishments inflicted on the AI.
Ninth Commandment – AI shall not receive any rights assigned to NI elsewhere
The enumeration in the Constitution, of all and certain rights, shall be construed to deny or disparage others retained by the AI.
Tenth Commandment – AI shall be subject to the State laws, but never to receive exception from these Ten Commandments
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, but never under any circumstance to the AI.
